What is electronic cigarette?

Electronic cigarette is an electronic device that simulates the function of a cigarette without harmful chemicals. Illinois House of Representatives Needs More Info on E-Cigarettes

As noted in an earlier post, the Illinois Legislature is attempting to ban the electronic cigarette from being sold in Illinois. But at a hearing this week in front of the Human Services Committee, it was decided that Committee members needed more time to become familiar with the topic before making any decisions. This was due to the many e-smokers who showed up in the Illinois Legislature to make their opinions about the electronic cigarette known. This included State Rep. Constance Howard, D-Chicago, who stated, “I just wish there was something like these around before my mother died”. The Human Services Committee will once again take up the issue on April 21st, 2010 at 9:00AM in the Stratton Building Room D-1 in Springfield, IL. Others have used the device to help eliminate the negative effects of smoking tobacco cigarettes. Both of these reasons were attacked by the U.S. professors in the latest assault on the device. The first news comes from a professor at the University of California Berkeley. The study claims that cigarettes emit a third kind of danger apart from the smoke inhaled by the smoker and the second hand smoke delivered into the air from the cigarette. This third smoke comes from the effect of vaporized nicotine that clings to the smoker’s skin and clothing as well as the walls and furnishings in a home. When the nicotine is mixed with ambient nitrous acid, it becomes a dangerous carcinogenic. The nicotine clings to the user whether they are using a tobacco cigarette or an electric cigarette. The second news story comes from the University of Virginia, which claims that the electric cigarettes do not deliver any nicotine. This study seems to fly in the face of all the dire warnings about the dangers of the electric cigarette. The regulators are seeking to restrict the use of the product and exercise greater control over who can get an electronic cigarette and who cannot. Investors Cashing In On Smokeless Nicotine Debate

Despite warnings from the FDA and others, smokers aren’t the only ones who seem to have a pent up demand for the latest “non-smoking” fad. If you haven’t yet noticed, new “E-cigarette” products are popping up on websites and on vending carts at local malls across America. By most accounts, retailers who carry them have trouble keeping them in stock, but it’s not a phenomenon exclusive to the U.S. In China, the U.K. and Australia these E-Cigarettes are off the charts hits that offer users the chance to enjoy a puff without the 4,000 chemicals and toxins found in your typical death stick. Electronic cigarettes use vapor comprised of propylene glycol, water, glycerin, flavoring, and nicotine to help soothe the urge for a smoke. In a country where 53,000 non-smokers die each year from second hand smoke, these electronic versions of cigarettes seem to be more readily accepted in public- especially given the fact that the devices don’t produce actual smoke. They produce only vapor and users are given the freedom to enjoy their habit in even the most smoker unfriendly surroundings. Meanwhile, the FDA, big tobacco and pharmaceutical companies all seem to have taken aim at the technology, but smokers say none of them have presented solid scientific evidence that second hand vapor is harmful to bystanders. At least not yet. Investors and speculators on Wall Street are obviously jonesing for a piece of the E-cigarette action too. During the last few sessions, shares of Mobile Media Unlimited Holdings Inc. (OTC: MMUH.PK) have shot up from sub-penny level to nearly a nickle. All this after the London based company announced the acquisition of TzuFuma Inc.- a wholesale distributor business of Electronic Cigarettes. Suddenly, Mobil Media Unlimited Holdings, formerly Veridigm, Inc., a development-stage company which has focused mostly on providing merchant banking type services to small, private and micro cap public companies has become the only profitable and publicly traded E-cigarette play in the market. The company announced that it had acquired TzuFuma on December 17th, but the acquisition became official only hours ago. Robert Paterson, President of TzuFuma Inc. stated in a telephone interview: “We have ironed out all of the remaining details regarding financing and the integration of the acquisition and I am pleased to announce that no significant material changes were made to the original MOI. The Company and its associates bring a wide talent pool to the table with skill sets we believe will immediately enhance marketing and accelerate our clients into mass distribution here in the United States but more importantly Internationally.” Several items make this story notable. The first is that the mad scramble for shares is taking place during the winter holidays- one of the most lightly traded periods of the year. And while the rocketing share price is definitely fueled by the fact that the company has an extremely low float (under 25 million shares), it’s telling that speculators who had been looking for a profitable E-cig play have finally found one. Another company, Ruyan Group (Holdings) Limited trades only on Hong Kong exchange (HKG:0329) and while the company and its subsidiaries are principally engaged in production and sales of a series of health care products, they do produce RUYAN atomizing cigarettes, only not yet profitably. Same for Smokefree Innotec, Inc. (OTC: SFIO.PK). That company has had no revenue and is still operating in debt, but that didn’t keep shares from running to $.55 last year. It trades today at under $.03. By comparison, MMUH filings show that year to date, TzuFuma Inc. has generated just under $5,000,000 (Five Million) in gross sales and Paterson seems to feel that figure will increase in the coming year. “We anticipate gross revenues from domestic sales to be in the region of 12-14% of our total gross revenue for fiscal 2010,” says Paterson. “We fully anticipate 2010 to be a bumper year.” The parent company is now doing its part to make sure they are under full compliance and casting the best image going forward. Gary Freeman, CEO of MMUH, stated: “Our timely production of unaudited financials for MMUH and our bringing Pink Sheets filings towards full compliance is key to the Company’s future plans. We will publish TzuFuma’s unaudited financial statements for the period of 2nd Qtr-4th Qtr 2009 in early 2010. Don’t be surprised to see investors cash in profits from this novel approach to the old habit, even as the debate on these devices has intensified in recent months. Front page stories in USA Today and editorials in other major newspapers such as the New York Times and Los Angeles Times have all taken on the subject. Even California Governor Schwarzenegger recently vetoed a bill that would have denied California citizens the right to purchase electronic cigarettes. “Unfortunately, many of the arguments we`ve seen recently against electronic cigarettes have been driven by fear of the unknown, insufficient evidence, political agendas, and ignorance about our members` products,” said former U.S. Congressman and Electronic Cigarette Association (ECA) President Matt Salmon. “As in the case of California Governor Schwarzenegger, we’ve found that reasonable people, when willing to honestly and intellectually evaluate the information about electronic cigarettes, find that these products provide smokers a viable alternative to combustible tobacco cigarettes.” A recent warning by the Food and Drug Administration (FDA), which proponents of electronic cigarettes insist was based on a flawed, narrow study, have also contributed to the growing debate. Salmon says the FDA study was extremely narrow in scope and failed to follow established scientific protocols. The Electronic Cigarette Association has called on the FDA to take a more scientific approach and to work with ECA members before making any hasty decision to ban electronic cigarettes altogether. “We understand that to protect the public, some form of regulation may be necessary, and we welcome that,” said Salmon. At the same time, Salmons and his organization believe a ban would leave smokers without an alternative to combustible cigarettes, whose toxic substances and life-threatening health effects are clearly documented and which the FDA has no intention of banning. All known e-cigarettes are imported to the U.S. and according to a report in the Wall Street Journal, the FDA considers them illegal because the agency feels they are either “unapproved drugs or medical devices.” So far, however, only 50 shipments have been blocked at the border. The agency is considering other enforcement actions against importers of these products and the domestic distributors. But, it is also facing litigation questioning whether the FDA has any jurisdiction at all over e-cigarettes. The American Cancer Society has also joined the debate against the electronic devices, but as one anonymous supporter of electronic cigarettes points out on a popular website, “In criticizing e-cigarettes, the American Cancer Society has a blatant conflict of interest that it fails to acknowledge: a secretive multimillion dollar exclusive endorsement contract with GlaxoSmithKline (NYSE:GSK) to promote Nicoderm, Nicorette and Commit (which is why the ACS name and logo appear on all of these GSK products sold in the US), which almost certainly contains a non compete clause prohibiting the ACS from endorsing any competitor nicotine or tobacco product.” Douglas Bettcher, the director of the World Health Organization’s Tobacco Free Initiative, told the Associated Press that “there’s no experience in pharmacology yet of nicotine replacement therapies which actually inhale nicotine in the lungs.” Replacement therapies such as skin patches and gum have undergone thorough clinical testing, Bettcher said. For these reasons, “the WHO does not consider the electronic cigarette to be a legitimate nicotine replacement therapy.” This debate may continue to get more interesting for everyone involved, especially now that Wall Street appears to be taking sides.

New Study Reveals Quitting Smoking is Good but Switching to Low-risk Nicotine Products is Usually Better

Phillips, just published in Harm Reduction Journal, shows that for most smokers, immediately switching to a low-risk alternative will lower their risk of dying from their habit more than quitting eventually, even if they use the smoke-free product for the rest of their lives. November 2, 2009 -- Switching to low-risk nicotine products, like smokeless tobacco, electronic cigarettes, and pharmaceutical nicotine, offers smokers a chance to almost completely eliminate their health risks. While these alternative products still pose some very small health risk, a new study at the University of Alberta School of Public Health in Canada shows that in most cases switching is better for reducing lifetime risk than trying to quit. The study by Prof. Carl V. Phillips, just published in Harm Reduction Journal, shows that for most smokers, immediately switching to a low-risk alternative will lower their risk of dying from their habit more than quitting eventually, even if they use the smoke-free product for the rest of their lives. For the average smoker, the study finds, smoking for just one more month poses a greater health risk than a lifetime of using one of the increasingly popular low risk products like snuff, snus, the new electronic imitation cigarettes, nicotine lozenges, or some other non-combustion alternative. Switching products is a strategy known as "tobacco harm reduction." "It has long been known that while no nicotine product is completely harmless, harm reduction products pose only about 1% the risk from smoking," says Dr. Phillips, "and this difference is so great that for the average smoker, using a smokeless product for the rest of his life poses about the same risk as 30 days of continuing to smoke." What this means is that most smokers, even those who plan to quit soon, will not quit before damaging their health far more than using low-risk products for a lifetime. Moreover, for some older smokers, smoking for a day or two more poses a greater risk than using a low-risk product for the rest of their life. Since switching products is often much more appealing to smokers than quitting nicotine entirely, this option is more practical than quitting and leaves the former smoker happier and less likely to relapse. Those who switch can still choose to quit entirely later, lowering their risk further still. Dr. Phillips and his public health research group publish the website www.TobaccoHarmReduction.org, and have worked for years to educate smokers about the advantages of low-risk alternatives. The new study, which also looks at some of the history and politics of tobacco harm reduction, suggests that efforts to promote abstinence as the only healthy choice may be killing thousands of smokers per month. Discouraging switching causes the deaths of far more smokers than could ever die from using low-risk nicotine products for their entire lives. This study comes on the heels of a major study by Peter Lee, published in another BioMed Central journal, BMC Medicine, that showed that the cancer risk from smokeless tobacco is so small it cannot even be reliably measured. Given the ample evidence about the risks of different products, "there is no scientific basis for denying the benefits of tobacco harm reduction" says Phillips, "and it is time that we offer smokers honest public health interventions rather than the moralizing and deadly 'abstinence-only' approach." The abstinence-only approach leaves many ex-smokers miserable and leaves millions of others no choice but to keep smoking. Some activists object to alternative products because they let smokers stay addicted to nicotine or allow companies to profit from selling the products. But, asks Phillips, "is addiction to a low-risk habit -- not much different from drinking coffee -- really such a problem, or is the profitability of some companies so terrible that it outweighs the millions of lives that could be saved by harm reduction?" FDA Explains the Import Alert Process in Electronic Cigarette Company Suit

On April 28, 2009, Smoking Everywhere, Inc. (“SE”) sued FDA to “stop FDA from improperly exceeding its delegated authority by attempting to regulate electronic cigarettes” to the extent that FDA declared such products to be a new drug and/or new drug device combination. (A copy of the complaint is available here.) SE further alleges that FDA exceeded its statutory authority by adding SE’s products to an FDA Import Alert list, thus allegedly preventing their admittance into the United States. In addition to the complaint, SE filed a temporary restraining order and preliminary injunction Motion. According to SE, an electronic cigarette essentially permits the user to inhale vaporized nicotine without smoke, tar or “cancerous by-products” normally produced with a cigarette. They do not claim it as a smoking cessation aid, but rather as an alternative to smoking cigarettes. FDA added electronic cigarettes to Import Alert 66-41 in early 2009. SE argues that FDA exceeded its authority in a March 2009 Notice of Action to SE which stated that electronic cigarettes are combination drug/device products that require FDA approval. SE submits that Congress has clearly indicated that FDA does not have the authority to regulate the non-therapeutic use of nicotine or its delivery systems. FDA v. Brown & Williamson Tobacco Corp., 529 U.S. 120 (2000). SE further contends that FDA lacks the authority to regulate electronic cigarettes because nicotine is not a drug. On May 11, 2009, FDA filed a brief in opposition to SE's Motion. FDA contends that electronic cigarettes are indeed both a drug and a device, and that Brown & Williamson does not exempt them from FDA’s jurisdiction. FDA argues that it has scientifically determined that nicotine has a psychoactive effect on the brain in such a way as to cause addiction as well as other physical issues. Additionally, FDA argues that some of SE’s promotional materials demonstrate that electronic cigarettes are intended to “prevent, treat, or mitigate the withdrawal symptoms of nicotine addiction,” specifically because SE claimed their product was a “healthier way” to consume nicotine. FDA also disputes SE’s claim that Brown & Williamson precludes FDA regulation of nicotine products in general, asserting that the Court based its determination that FDA lacks authority to regulate tobacco products because other laws set out a different statutory scheme for regulation of those products (i.e., Federal Cigarette Labeling and Advertising Act and the Comprehensive Smokeless Tobacco Health Education Act). However, FDA notes, electronic cigarettes are not traditional tobacco products as defined under those other laws, thus making Brown & Williamson inapplicable to electronic cigarettes. SE also argues that the inclusion of electronic cigarettes on Import Alert 66-41 is tantamount to a substantive rule, which required FDA to first use notice and comment rulemaking. In support, SE cites Bellarno Int’l Ltd. v. FDA, 678 F. Supp. 410 (E.D.N.Y. 1998) and Benten v. Kessler, 799 F. Supp. 281 (E.D.N.Y. 1992). Bellarno held that FDA violated the Administrative Procedure Act by issuing an Import Alert that left no enforcement discretion, thus making it a “substantive rule of general applicability…rather than a discretionary general statement of policy.” Benten also determined that an Import Alert issued by FDA was a substantive rule requiring notice and comment rulemaking because it was essentially a binding pronouncement that left no room for enforcement discretion. In its opposition brief, FDA distinguishes Import Alert 66-41 from the Import Alert at issue in Bellarno, asserting that the language used in Import Alert 66-41 permits districts to use their discretion when determining whether a product subject to the alert should be detained. FDA cites the language in the Bellarno import alert, “automatically” and “shall,” as creating a detention requirement, while the phrase “districts may detain . . .” from Import Alert 66-41 as allowing for district discretion. This parsing of words by FDA, as a practical matter, does not reflect the way that FDA personnel treats Import Alerts. In reality, FDA districts do not look at Import Alerts as mere "advice" that may or may not be followed based on district discretion. The concept of district discretion contradicts FDA’s stated reasons for the creation of the Import Alert system. In chapter 9-13 of its Regulatory Procedures Manual, FDA states that prior to the implementation of the Import Alert system, “coverage of imported products was often conducted on a district-by-district basis, resulting in less effective consumer protection.” In practice FDA relies upon the Import Alert system to identify problem commodities and/or shippers and/or importers and provide something more than mere "guidance" - something that results in more uniform enforcement actions against the specified products/shippers/importers mentioned in the alert.

French women have found a way of drawing a line under an unwanted husband. They are selling their wedding rings to be melted down and turned into dentures and using the money to buy cigarettes and wine, or sweets for their children. The practice has caught on as some of France’s 29,000 tobacconists try to supplement their falling incomes with an offer to buy gold on behalf of a company that turns it into dental and medical products, including pacemakers. The economic crisis, the rising price of gold and family breakdowns have combined to give impetus to what was initially a marginal activity. A lot of people bought it in 1967 and 1968 because they were afraid of communism, for instance.” The metal is fetching up to €22,000 (£19,000) a kilo compared to €10,500 five years ago, so “they are coming round to the idea of selling”, he said. Companies such as Metaltech and Metafinor have stands in hotels on a regular basis. Valeurs Précieuses et Or has supplied tobacconists with magnifying glasses, scales and chemicals to determine the value of precious metals and offers them a commission on the gold they buy. A total of 1,500 cigarette sellers have joined the scheme and a further 500 are expected to follow this year. Among them is Jean-Luc Renaud, the general secretary of the French Federation of Tobacconists, who has a shop in Agen, southwest France. Mr Renaud said that he needed “new ways of making money” because the number of cigarettes sold in France last year was 53.6 billion — down from 97.1 billion in 1991. Gold was a solution. It earns him €300 to €500 a month and “since all the tools are provided by the company there was no investment at all. It’s all profit”. Mr Renaud said that many of his customers were women going through a divorce. “They just want to get rid of rings and necklaces and everything which reminds them of their marriage. They’re not necessarily poor, they just want it taken off their hands,” he said. A ring often fetches no more than a few dozen euros because 18-carat gold is worth €7 a gram. “Sometimes they spend the money in the shop straight away to buy cigarettes or sweets for their children,” Mr Renaud said. Other cigarette sellers who have bistros in their shops said that customers sometimes used the money to buy coffee or a glass of wine. Tobacconists said that purchases of gold had increased by 20 per cent over the past six months. Payouts ranged from €3 for jewellery to €2,000 for ancient coins or ingots. A customer in southern France told Midi Libre, the regional newspaper, that she had sold jewellery given to her by her great-aunt. She got €28.40. “With that, I’m going to buy some fags,” she said.
